Earlier this week, the Occupational Safety and Health Administration (“OSHA’) withdrew its vaccine and testing mandate for “large employers.”
The mandate would have required employers with 100 or more employees to implement a written policy that all employees either get vaccinated or undergo weekly testing. Just two weeks ago, the Supreme Court issued a stay on the mandate, finding OSHA exceeded its authority.
The Biden Administration has unilaterally decided to end the legal battle the mandate currently faces, asking lower courts of appeals, particularly the 6th Circuit, (which has jurisdiction over the matter), to dismiss all cases related to the mandate. For now, OSHA seeks to use its resources to create a permanent COVID safety standard for all health care workers.
